Очень часто при составлении проектной документации специалисты ПТО задаются вопросом: «какая гарантия на нержавеющий крепёж?»
Согласно действующим в России нормативным документам:
– крепёжные изделия из коррозионно-стойких сталей марки А2, А4 или С1 не подвергаются заметным коррозионным разрушениям вплоть до 50 лет и более при соблюдении требований технических регламентов;
– ГК РФ* задаёт 2 года на предъявление претензий, связанных с ненадлежащим качеством товара, лишь в том случае, если монтаж и эксплуатация этих изделий укладывались в требования действующих регламентов.

На основании чего сделано указанное выше заключение?
Попробуем вместе с Вами разобраться в аспектах гражданского права и технических нормативных актов РФ касающихся гарантийных обязательств на крепёжные изделия из коррозионно-стойких сталей.
Качество товара и гарантийный срок в правовом поле задаёт Гражданский кодекс России (далее ГК РФ).
Ст.469, п.1: «Продавец обязан передать покупателю товар, качество которого соответствует договору купли-продажи.»
Согласно ст.470 п.2 гарантийным сроком можно назвать определённое время, установленное договором купли-продажи, в течение которого товар должен соответствовать требованиям к качеству.
Где же указано качество, которому должен соответствовать нержавеющий крепёж?
Ст.469, п.4: «Если законом или в установленном им порядке предусмотрены обязательные требования к качеству продаваемого товара, то продавец, осуществляющий предпринимательскую деятельность, обязан передать покупателю товар, соответствующий этим обязательным требованиям.»
На территории РФ свойства крепёжных изделий из коррозионно-стойких сталей А2 и А4 регламентирует ГОСТ ISO 3506–2014.
Этот стандарт задаёт не только химический состав сталей и механические свойства крепёжных изделий.
В справочном порядке в ГОСТ ISO 3506–2014 приводится характеристика коррозионной стойкости нержавеющего крепежа с учётом среды эксплуатации.
Срок службы нержавеющих болтов, винтов, шпилек, гаек, шайб и прочих схожих крепёжных изделий.
Для (всех) крепёжных изделий можно назвать приемлемым определение по ГОСТ Р 57787-2017:
«срок службы : Период времени от начала эксплуатации до достижения им предельного состояния»
Срок службы нержавеющего крепежа зависит от множества факторов, не связанных с качеством товара, а обусловленных условиями эксплуатации крепёжного узла:
– агрессивность среды, в частности по СП 28.13330.2012 и ГОСТ ISO 3506-2014 (справочные Приложения);
– температурные режимы эксплуатации, в первую очередь по ГОСТ ISO 3506-2014 (справочные Приложения);
– характер и величина нагрузок должны удовлетворять требованиям СП 16.13330.2017 и ГОСТ ISO 3506-2014;
– и даже соблюдение условий монтажа, заданных стандартами, в первую очередь ГОСТ ISO 3506-2014.
Срок службы вытяжных заклёпок и нержавеющих анкеров ELNAR®, прошедших подтверждение пригодности Минстроем России,
зависит от условий эксплуатации, заданных в соответствующих Технических оценках ФАУ ФЦС:
– в Технической оценке пригодности стальных распорных анкеров ESI1K к ТС 5540-18 МИНРСТРОЙ РФ;
– в Технической оценке пригодности вытяжных заклёпок ELNAR® к ТС 5746-19 МИНРСТРОЙ РФ;
В этом свете при соблюдении требований технических регламентов к расчёту (проектированию), установке и эксплуатации крепёжного узла
срок службы крепежа из коррозионно-стойких сталей не ограничен нормативными требованиями.
Он не зависит от качественных показателей изделий, а обусловлен лишь условиями эксплуатации и качеством установки в проектное положение*.
* если мы говорим о крепеже, товарные свойства которого полностью соответствуют требованиям ГОСТов или Технических оценок.
Где прописывается гарантийный срок на нержавеющие крепёжные изделия?
Гарантийный срок не является обязательным условием.
Стороны вправе не задавать срок действия гарантии качества, согласно ст.470, п.2 ГК РФ.
Тем не менее, в ст.477, п.2 ГК РФ сказано:
«Если на товар не установлен гарантийный срок или срок годности, требования, связанные с недостатками товара, могут быть предъявлены покупателем при условии, что недостатки проданного товара были обнаружены в разумный срок, но в пределах двух лет со дня передачи товара покупателю либо в пределах более длительного срока, когда такой срок установлен законом или договором купли-продажи»
